Undercharged for car

I Bought a car, the dealer created a sales invoice, which said I owed £12k. They funded £3k of the deal and I had to pay the remaining £9k. I paid £1k on the day and then was returning 2 days later to complete the deal. On the day I was then presented with another invoice, stating Final Payment of £7k. That was £1k less than expected. 2 months later they are chasing me for the £1k. They have a sales order form, I have a receipt clearly stating Final Payment received.

We both signed the original order form and the final payment notice.

Where do I stand?

    You owe the money, the contract was for 12k you paid 11 and you even knew at the time a mistake had been made but kept silent. Mistakes are allowed for in calculations, it's the contract price that counts.

    If it was £1000 less than expected why did you not raise this with them at the time?
  • If they had accidently charged you £1,000 more than was originally agreed would you have happily been saying that its what the final invoice said so alls fair or would you be trying to get that £1k back?

    By knowingly taking advantage of their mistake.

    The bottom line is that they could sue you for the money. If they can demonstrate (on the balance of probabilities - not beyond reasonable doubt) that you knew they had made a mistake and took advantage of that then there's a good chance you'll lose and end up with a judgement against you.

    Civil courts tend to be a bit pot-luck though so although they should win, you never quite know what will happen on the day. If you think it's worth a punt and the potential aggro of going to court etc then don't pay.

    the OP didn't start it but they did resurrect it by posting to it. In this case I think a separate thread was the better option so wealdroam's complaint is probably unjustified.
