What matters is the value of the house, not what was paid in.0

He may have to pay money to you for his part of the debt that you are in for the negative equity of the house and any other debts there may be. As much as assets are split, so can debts be.
Get some proper advice as it could be well worth it in the long run as this doesn't sound like it will be entirely straight forward.
