PCN from PCM - appeal rejected, referred to IAS

Hi,

Unfortunately for me, I have found this forum a bit late:(

My husband received a PCN on his windscreen on 4th October 2014, in London, England issued by PCM

We appealed; and here is a copy of the letter we sent:

To Whom It May Concern
I am writing in reference to the invoice no: *********. I will not be paying this. My reasons are as follows:

• I have been parking on Warriner Drive for a while now and on this occasion I did not notice any changes to Warriner Drive that would suggest that there were any parking restrictions.

• There were no signs to mark the entrance of the alleged controlled zone as Private Land.

• There were no signs to indicate what constituted as areas of “No Parking” on this Public Road: Warriner Drive.

• These bays (which are fifteen or so in number) have been used by customers of the shop (****) for years.

• I reverse parked into a bay and as I left my vehicle I noticed a yellow coloured sign to my left but was unable to understand it as it was in another language. I went into the shop to enquire. Within a few minutes I returned and found a ticket on my windscreen. As I looked up I saw signs that were on the other side of the fence to which I was facing now. The signs were not easy to read as they were behind the alleged controlled zone erected on another building. I had to get close to the fence to read them.

• The signage is inadequate and does not conform to legislation.

• The telephone numbers given on the inadequate signage were only available for inquiry on Monday to Friday. I was there on a Saturday.

• The sign instructs to inquire and as per “rules of a grace period” I did go to inquire from the shop which had also displayed a sign in another language for its customers. I returned within a few minutes to move my vehicle and found an invoice on my windscreen. No grace period was allowed.

I have received a reply from PCM and no surprise to you, they have rejected and given the option to appeal via IAS.


Have I messed this up? Should I just pay up?


Further details:

I searched the council website which details which roads are public and which have private land on them. This Warriner Drive is NOT recorded as private land on the website.

Please help. I don't want to enter in to this battle if I have already lost it because of my first letter. Thanks

  • If u have your back to the signs. And you look on the left side there is a wall (not in pictures) , The same yellow sign is on the wall, thats the sign i seen.

    Forget the IAS appeal and read harni2013's thread and aass11's thread. Send PCM a nice 'Notice of Cancellation' (as explained in umpteen threads in October) and start ignoring them after that unless they start a court claim. I can't repeat the same info yet again here...sorry it's pointless just repeating it and too time consuming! So read the other threads - there are more PCM threads than just those two, easily found by searching the forum for 'PCM'.

    IAS isn't worth it - allegedly 'not independent' and as useful to consumers as a chocolate fireguard. The IPC has, as far as posters have shown us conclusively in their threads, failed to provide a fair, consumer-friendly appeals service. No-one should be expected to provide more detail and evidence than would be needed in an average small claims court defence for a poxy 'appeal', only to get pathetically refused by an unnamed person whose opinions appear to be 'without merit'. The whole system is already broken and seems beyond redemption - hopefully only a matter of time before the DVLA realise the IAS (allegedly) isn't working well and the unnamed Assessors in their ivory towers, can't insist on knowing or guessing who was driving (bloody ridiculous when they know full well the will of Parliament when the POFA Bill was being heard, was that PPCs cannot insist on a keeper saying who was driving).

    So send a Notice of Cancellation (covered loads of times here) THEN ignore PCM and their silly debt collector letters that will follow. Read the other threads & if you get a small claim we'll help you defend it robustly.

    Yes all of the above applies, in fact the driver is arguably in a better position to 'Cancel the contract'!
