Help....am I entitled to a refund

I purchase a pair of Hunter wellies for £60 on 28/10/13. Within 6 months they split on the sole and the trader replaced them for free. Now the second pair have split on the sole and the trader do not sell another wellie that is a similar look to the Hunter, or around that price. I have had to buy new wellies from a different trader and have requested a refund as per the 'Sale of goods act - 1979' as the goods were not fit for purpose. The trader has refused to refund me and only offers a credit note. Please help - I don't believe this to be right!

Fit for purpose does not apply here, as they were fit for purpose UNTIL they split, fit for purpose only applies when you first buy something and they can not be used, you used them for 6 months so how can you say they were not fit for purpose.
After 6 months YOU have to prove they were sold to you with a defect...probably impossible to do and costly, even then they only have to repair them or offer you a refund taking into account how long you have had them, so if they decide not to repair and offer a refund (it's their choice) it would only be a limited amount.
Take the credit note it's the best you will get and imo not a bad offer.
Quoting the sales of goods act is not going to help you.
You have had 6months of use, do you really think you should get a full refund?0 -
On another note, move away from the terrible Chinese made hunters and buy some proper boots. I've got a pair of Le Chameau boots, worn most days and they are years old, still quality!0

I am from a farming background, and yes, I believe that wellies should last longer that 6 months but as you say, if I have no chance then a credit note will have to do.
I have already purchased a pair of Le Chemeau's, just waiting for delivery.
I think it just shows that the public have no real rights when it comes to goods purchase, with or without a receipt.0
