  • Are the manufacturer saying its inherently faulty? Are they willing to put this in writing? If so and if it is an indefinite waiting time, you might have more luck going through your network operator under the sale of goods and services act.

    No I haven't had anything from them admitting its a manufacturing fault, but that fact that i barely mentioned what was wrong and they booked it straight in for repair, i also see a lot of other people online talking about the same problem. I doubt HTC would admit blame unless they were publicly pushed to do so.

    My network is orange and they were willing to fix the phone up until the noticed it was a Dial a phone one ("not orange branded" was how they said it.) Basically i pay orange £31 and get a handful on minutes texts and data, and dial a phone game me a phone for free, it seems like i am getting stiffed on my monthly payments if im not paying for a phone and i only get network coverage but i guess thats just how they do it. Anyway they directed me to phones for you and told me they would fix it, even though they are in administration they would still fix a faulty phone.......... Yeah that didnt happen

    Well i have arranged to send the mini 2 back and wait for my M7, still no idea how long it will be but if it drags on i might see how much i would have to pay for an M8.... We will see!

    Why would the network operator have any obligation for a handset they did not supply and had nothing to do with?

    Orange is still supplying their service via the SIM card that is presumably still working?

    Because under the sale of goods and services act.....your rights are with the service provider.

    When you buy goods on their own, with no service attached, you're protected by the Sales of Goods Act.

    Yet if you buy goods as part of a service, eg, a handset with a mobile contract or a boiler that you ask a gas company to fit, you're protected by the Supply of Goods and Services Act.

    And if the goods supplied as part of the service become faulty, it's the service provider that's responsible for sorting the problems, not the supplier of the goods.

    The protection's the same as the Sale of Goods Act, though - in short, the Sad Fart rights. It's just that complaints must be made under the service law instead.

  • HTC repair are a shambles. They "lost" my phone when in for repair a couple of years ago. Only sorted when Watchdog got involved and featured them on the programme.

    Complain, complain,complain, escalate, contact Watchdog, spam their Facebook page do everything in your power to draw unwanted attention to their failings.

    Keep a detailed log of all contact, who you spoke to, times, what was said, basicly record EVERYTHING.

    A quick look at their Facebook page, seems not a lot has changed, a lot of very unhappy people.
