Pay and display ticket on private carpark moved down dashboard

My pay and display parking ticket which I originally displayed on my dashboard ended up moving

My children were getting in and out of the car all day I'd left my keys with my friend as I was running a marathon at the time

the doors would have probably been left open longer than normal as my daughter is disabled so takes a long time getting in and out of the car ( they went back to eat there ) and getting the wheelchair in and out and my friend even moved the car to an easier space in the same car park

either way the ticket which was on a flimsy piece of paper ( not a sticker ticket ) slid down the dash board and when I got back to the car with my children after running the marathon I noticed at " fixed charge notice" stuck to my windscreen

the reason was failure to display a valid pay and display ticket

How am I fixed to appeal this?

I did buy one but didn't stay in place, my children are hardly going to notice it had moved and my friend certainly didn't

They apparently took a photo of the front of my car which shows that the ticket wasn't showing on the dash and couldn't be seen ( which it couldn't as it had slipped right down the front of the dash board

  • First thing to do is look at NEWBIES thread and follow this to the letter.

    Mitigating factors are not of interest to PPC's they are only after your money and the appeal is on points of law which are all laid out in the NEWBIES thread.

    Don't indicate who the driver was and do a first soft appeal which will be turned down. Second appeal to POPLA or IAS will need further work and help.

    yes looked at the newbies appeal and it said not to write the letter if it is from napier

    the ticket on the windscreen is from napier so now what do I do?

    I have taken a photograph of the pay and display ticket and the fixed charge notice to my windscreen ( how can i send the photograph here for you to see? )

    according the newbies advice it says to wait until I get postal penalty notice

    The site says that I can only appeal through their site or by post with their appeal form only
  • As its napier you may wish to consider the use of a service address.

    so if I appeal and ask them to send the details to the service address rather than the registered keep it may then keep them at bay? as they cannot then go to the DVLA to get the registered vehicle keeper details as this means they are breaching their contract?

    Works best if driver is NOT Registered Keeper. PPCs and the DVLA are, how shall we say, "relaxed" about following some procedures.

    You are muddling up two distinct choices of ways to address this.

    EnigmaPart1 runs ParkingTicketAppeals which offers various services which are very useful to motorists with private parking tickets. His solution is for the driver to appeal and give a service address so the keeper cannot be touched and the driver is also protected by the service address. If you want to do that then contact PTA on their website which you can Google.

    This is different from the advice I set out in the Newbies thread. In the Newbies thread I say that I recommend the keeper appeals without saying who was driving.

    However (unless you are not the registered keeper yourself) you have already blown it as far as our forum advice option is concerned because Napier read this forum and they will have already seen your first post, where you have gone and admitted who was driving.

    On balance you probably need Enigma's help now. Never jump straight in after reading a clear forum sticky post, that tells you not to admit who was driving and to appeal as keeper, then go and post like you did, telling the World who was driving! Oops - too late to change it now. Not a good plan with Napier snooping around.
