Divorce legal advise please

Hi

if a person is separated from his/her partner for like 4 years and had 2 kids when they were together, paid child maintenance for last 4 years however haven't divorced yet.

now they want to divorce question is

what husband has earned in last 4 years he has to share it such as a property which he bought on his own? or any savings?

    I'm sure someone more knowledgeable will be along shortly, but I guess if they have been legally separated or not will come in to it....
  • It was 20 years ago but when my OH got divorced the financial disclosure was based on the details at the time of divorce and not the position 2 years ago which was when they separated. So it included his new house and mortgage and up to date figures for savings (hers mainly) etc it was before the pension sharing arrangements though.

    Until divorced and the finances sorted out assets are still marital even if you are separated. Hence the usual advice to get the financial agreement sorted out as soon as possible particularly if property is involved.

    What gets included in the disclosure and what is agreed between the parties are not necessarily linked. You can agree whatever split you want if the split is amicable.
