Non Fault Accident - Should I claim?

    I had a quick look at the mib site and there's no mention of a minimum claim, only that there is a backlog and it will likely take 2 years to get a decision.

    "Low Value Personal Injury Claims
    Agreed in conjunction with the Ministry of Justice, there is an electronic portal in place to streamline low value personal injury claims valued between £1,000- £25,000. This process has been designed to enable faster agreement on liability and payment of low cost Road Traffic Accident (RTA) injury claims. For further information, or if your injury case falls between £1,000 and £25,000, please visit www.claimsportal.org.uk."

    Just thought I'd give a bit of an update.


    I did make a claim through the MIB they're currently processing it and are also paying for me to have Physio. Which I'm really grateful for because I have been suffering with some severe back and shoulder pain which only started a couple of weeks after the accident.


    Has anyone had a claim via the MIB before? Do you know roughly how long it takes? When I spoke with them they wouldn't really give me a time frame.
  • MIB typically take a couple of months to complete enquiries into liability, which mainly involves them obtaining the report from the police in order to validate the credibility of your story (so that you don't get paid out if it just looks like you ran out of talent and put the car into a tree yourself and then invent the drifter story afterwards)

    So long as the description you give now tallies with what was reported to the police at the time, the odds are they will accept the claim and compensate you.

    What they will need to to is arrange for you to have an independent medical examination, which they will probably arrange via a company called Premex. once the report from the independent doctor is available and confirms the nature of injuries suffered and the estimated length your recovery will take, they will be in a position to make an offer of settlement for your injuries.

    Likely to be another few months at a guess.

    Thanks, the guy on the phone did mention after the Physio is happy to sign me off not requiring any more treatment then I would need to have a medical.


    Luckily there was an independent witness who from what the MIB were saying has confirmed what happened.


    Fingers crossed it all runs smoothly
