Wrong item delivered in "right packaging"

I have ordered 3 other items which are all fine so would I still be able to get refund on delivery?
I read the invoice they sent and I just noticed that it says that it is packed by special packing instructions. And the special packing instruction as stated on there invoice is "The items detailed above have been individually verified and packed in accordance with the special packaging instructions. All items have been checked to be free from damage at the time of packing." - I really wish I can attach pictures.
Now considering this, would I be alone in thinking they packaged wrong item on purpose?0 -
Just some update on this matter.
The trader has agreed for full refund, carriage fee (£12 or so) and a free game download voucher, which I took. I will have to first send back the item to see if they keep their word but I just want to let people know the outcome.
And I was also advised by Citizen Advice about new amendments to Consumer Protection Regulation which came in effect from 1st Oct 2014 that "if a consumer is subjected to aggressive business practices; for example a company refusing to comply with a consumers statutory rights; the consumer could look to pursue the trader for an amount of damages that would directly reflect any additional losses they have incurred as a direct consequence of the trader’s actions and also for any alarm, distress and inconvenience suffered." Of course, one would need to take the trader to civil court if the difference is not settled between you and trader or trader refuses to offer any redress. But since its difficult to quantify my loss just as some of you pointed out I am guessing my case will be a difficult one. I probably end up with more headache if I go through civil court and I wasn't thinking any higher than £50 for redress so its kind of waste of energy when considering the starting nominal fee of £30 for civil court actions.
Many thanks for opinions and advices though! I guess grief caused by the trader is still very much grey area.0
