Mitigation of loss (Warning - DM Article)

Seen this, it seems to be a suitable device for Germany... I am musing over how the device would work in PPC World, it could be argued that they failed to mitigate loss by not giving the driver a chance to move.

I know its pie in the sky, but overall a good idea.

I can't see any PPC or CEO using the device to give the driver a chance to move, but reading the article, it is German Law "German traffic wardens have to find the cheapest and most efficient way of solving a parking problem"

What a great device. Position it in the windscreen right where the parking weasel is going to stick the fake ticket, they can't claim not to have seen it, clear failure to mitigate losses if they don't contact the driver.

Of course, they'll just say they pressed the button and nothing happened.

This idea could be extended to private parking as well.

A large company such as Parking Eye could offer a downloadable app for smartphones, and people could use that to register their registration numbers on the system.

Then, when one of PE's ANPR cameras picks up a registered user at the entrance to the car park, it could flash a message to the phone, saying "Your 2 hour free parking session has started, and ends at 10:25am".

If it hasn't detected an exit after 1h 45m, it could then send another message saying "Your free parking expires in 15 minutes, please complete your shopping and make your way to your vehicle".

It would save them a fortune on all those 'losses' they make from people breaching the terms of parking, and they would also have to spend far less on legal fees and LPC reps.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.
