Evidence Pack

After looking through some of the threads, I have found "evidence pack" mentioned a few times.

I have no idea what this is? - sorry if I come across dumb. Not had a ticket before and never thought I would have to go through this.

thank you in advance.

When you send in your initial appeal to the PPC they reject it and (should) give you an evidence pack. You then go through it with a fine tooth comb and rubbish everything they say in your second (PoPLA) appeal.

    Dear Zoe

Please see attached photograph that clearly show you had failed to display a valid ticket.

You are quite correct you do not have to follow POPLA’s decision, however the charge will increase, and if payment is still not made we will proceed via the small claims court where a district judge will not overturn an independent appeal decision.

    Regards
    Jeff

You should really be keeping this all in one thread if it pertains to the PoPLA appeal you have already mentioned.

However, you could reply to this line, "and if payment is still not made we will proceed via the small claims court where a district judge will not overturn an independent appeal decision."

with the response. Don't tell lies. See you in court.

Personally I think you should not have contacted the PPC and just waited out the debt collector letters and threats until they stopped or issued you with a LBCC claim, then come back here for further advice.

I don't think that is quite right. Should the evidence pack not come after you have submitted your POPLA appeal?

You appeal, they try to rebuff it with their evidence pack, which you then rebuff and POPLA decide?

OP, did you receive anything from the PPC after you submitted your POPLA appeal and before the decision?
  • Didn't recieve anything...ticket was issues on 7th August, Appealed on 8th to All Parking Services UK Ltd and then to POPLA on 11th August.

Didnt hear a thing from them until they sent the reminder on 13th October.

I think they are a fairly new BPA member:

    http://www.britishparking.co.uk/Approved-Operators

    http://www.allparkingservicesukltd.com/Legal.html

''There are several internet forums that deal specifically with parking charge notices issued by private parking enforcement companies. The information on these forums are often incorrect and the people offering this advice are not legally qualified in any way.''

Methinks they doth protest too much! :D

Take a screen print NOW of this page in case they change it!!

    http://www.allparkingservicesukltd.com/Self---Ticketing-Service.html

''Most car parking firms will either keep all the revenue they collect from people abusing your parking facilities or only pay £10.00 commission, at APS we feel you should benefit from parking abusers & with times getting hard let your car park earn you some money, so we will give you £20.00 commission on every paid ticket.''

Not a GPEOL then, Jeff Bell!

Who was the landowner in your case, is it a company or Hospital you can ask questions of, such as 'in the past year, how much in revenue has been raised from these tickets?' and 'what is the purpose of the charge, is it a deterrent? Is it based upon your loss? If so how do you explain the £20 revenue sharing?'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
