Some issue court claims, a lot dont bother.0 -
The decision is binding on them, not on you. You can still choose not to play along. It will then be up to them to either try and chase it, and maybe issue a claim and try it in court.
Unless you can show the assessor made a mistake in law then you cant ask them to look at it again.
You needed to from the beginning put the burden of proof on them to account for the charge.0 -
Could the OP still rely on GPEOL in Court?0

Yes but there is more to a court defence then GPEOL.0 -
This is a case which would be defensible in court, IMHO.0

thank you all.
Coupon Mad - Thank you for all your help and advice.
I haven’t received anything but the "reminder notice" through the post (I feel quite lucky now, as others are clearly getting bombarded).
I didn't receive and evidence pack. the first pictures I saw were today.
The ticket was issue on 7th August. I appealed on the 8th to All Parking Services UK Ltd, who rejected my appeal and gave me a POPLA number.
I submitted my POPLA appeal on the 11th August and was told I would hear on or around the 16th September.
A letter was sent to my address on the 26th September which we didn't receive and forward on via email on the 23rd October after I contacted them saying we hadn't heard.
I have phoned POPLA this afternoon, and told them I had not ever received any evidence pack. Richard Reeve advised I emailed the enquiries email address and let them know and ask for the case to be re-assessed.
is this right?:jMarried on 12.12.12 to the best man alive! - FACT!:j0 -
kind if
You email Rreeve@popla.org.uk directly and tell them this case should be set aside, a new date listed for the hearing and the evidence sent to you.
It then gives you chance to add some extra bits
also complain to Gemma Ridgewell <gemma.r@britishparking.co.uk> shes actually pretty good to her credit!! about lack of popla pack. She does work straight away on this and always gets results for me0 -
Someone is emailing me but not including their signature from the BPA.
This is the email they sent me this afternoon which I have just read:
Dear Ms V,
Thank you for your e-mail.
Once the ticket was issued, you needed to appeal to the operator. If the operator rejects your appeal, they would have provided you with details on how to appeal to POPLA.
I note you have appealed to POPLA and lost. If you did not see the evidence the operator provided to POPLA, you need to contact POPLA directly to see if they will re-hear your case as you did not see the evidence.
When did POPLA decide on your appeal?
Kind regards,
