Buyer protection flaw

I recently had to open a case/request for a refund for an item not received. The seller "refunded" with an eCheque, which has now bounced. So the PayPal refund status is "removed" and I had an email from PayPal stating that the refund had failed and I should contact the seller.
The ebay case remains open, but there is no option to escalate it, as ebay consider the item refunded. The only option presented is to close the case (which clearly I'm not going to do, but it will time out eventually). I rang ebay and after half an hour managed to speak to their Indian call centre (purchase was from my private account - funny, I always get Ireland from my business one). I wasn't entirely sure she grasped the situation, but she said she was making notes and would then put me through to the resolution team...and dumped me right back into the never-ending phone queue. I couldn't hold all day so rang off after another 10mins.
The amount is not huge but the principle is bloody annoying, especially with ebay plastering their buyer protection ads all over the place! It seems I will not be getting my money back, not without all day on the phone. :mad:

As another thought, is there a way of disputing via Paypal, either by the failed refund or the original transaction?.0 -
