Selling property/removing a charge

I'm just at the point of exchanging on my property following a hideous divorce whereby my ex has a charge relating to 25% of any profit that I make on selling the property. However, the sale price falls short of the mortgage (it was a huge mortgage) by £382.00, yet my solicitor says he still has to sign off the charge before the sale can go through. I don't get it, it's in negative equity, to which he should in reality be responsible for half of the £382.00 (particularly because when he was in residence of the house he allowed it to go to repossession 3 times, accumulating legal charges which have taken the redemption figure over the sale price). He will not cooperate in any way in the signing of documents (laughingly I had to go back to court myself to get the transfer deed signed by a judge, and I had to lodge the 25% charge myself on his behalf....der!!) yet now it seems I cannot complete the sale because I need his cooperation. The final result would be repossession. My conveyancing solicitor does not seem to know what to do to get the sale completed being that he is unreachable and refusing to sign. Any ideas anyone?

Not something I know about, but would the charge have been put on by a court? In which case you could go back to the court.

Is it allowable for you to pay that £382 yourself? (obviously followed by trying personally to get his share back off him).
I don't know how these things work, but I'd haul out my debit card and say I was going to do so on the spot and then it could proceed.0
