New Car Issues

Hi All

I am asking this on behalf of my dad

He bought a brand new Ford earlier this year and basically we have lost count the times it has had to go back to the dealership to repair a mysterious leak that leaves pools in the drivers footwell. Each time they have it for week (s), say they have fixed it then return it and it happens again

My dad is a patient man in allowing them this many times to repair it, but last time he hinted that if it is not done this time then he would be looking at other options. He said the sales man strongly hinted that if they did something like that, then a deduction would be made for the wear and tear as the car has been used

Now to me, and I admit I am no where close to being an expert, this would fall under the sale of goods act (as it was a bard new car) and not fit for purpose. As they have had ample oportunities to repair it, what would be my dad's position on a replacement or a refund?

Could he get a brand new model of the same specification, or would it have to be one that is of the same milleage (he has not even done 2000), and would the refund be full, or can the company make a deduction?

  • Sales of goods act does allow a deduction for the use received from the item before its return.

    That said, depending on just how long he has had the car, then the dealership should be able to do something fairly reasonable when they are playing with their margins plus the Ford UK contribution assuming its a franchise garage.

    Go down and have a fairly vocal discussion with the sales manager/ director and/or his boss in the middle of their show room and you'll probably find them more accommodating than the sales guy or if you are ushered off to an office out of earshot of everyone else

    A brand new car is a no chance, a car of the same age and spec is.


    The law allows for faulty used goods to be replaced like for like so legally they are right.

    Has this been escalated to Ford UK? The dealer should have done this (he can pass the buck) if not you need to get that done.

    The OP doesnt say how long this has actually been going on for but a colleague had a VW Scirocco that continuously had the engine management light coming on and the car cutting out.

    Dumped the 9 month old car in the middle of their forecourt, spoke the the MD in the middle of the shop floor and got his brand new car delivered about 2 weeks later whilst getting a reasonable sized courtesy car whilst waiting.

    It not going to be their first offer but it can be achievable in certain circumstances.

    You need to do several things as below;
    • List the dates to car has been returned to the dealer
    • List the amount of time the car has spent in the dealer for repair
    • Find out who runs the whole dealership, NOT just the actual car dealer you bought the car from and contact the director of the dealership group
    • Be very clear exactly what you want from the dealer
    • Be very clear and concise about why you think you should get what you want
    • Don't get angry with anyone (I know this bit can be tough!)
    I had a similar problem and got a new car, it wasn't Ford but the principle is the same and my car was about 6-7 months old but I kept pressing and eventually the Dealer Principle offered a choice of refund, New car the same or new car different make that could be supplied by the group.
