Would ebay consider this misleading?

Just curiosity really. I'm after some software for 3 computers and there is a listing which says 3 licences in the title. However the main body states that the seller has no idea how many of the licences they have used and it may be that all 3 have gone and the software is useless. Actual wording "NOT SURE IF ANY USE ARE LEFT OR NOT. PLZ ONLY BID IF YOU UNDERSTAND IT MAY OR MAY NOT HAVE ANY USE LEFT ON IT"

It has attracted quite a high bidding level for something that may be useless, so I was wondering whether the winning bidder could buy it, claim it was useless whether it was or not, and get a refund either way? Otherwise I can't see why people are wasting their money.

Pedant alert - it's could have, not could of.

    They may or may not get their money back but it is possible. Someone who knows what they are doing may have asked the seller a question and made their mind up to bid based on his answer. The other likely reason is that other bidders haven't read the description.

    Dont touch sellers like that with a bargepole.

    Report their listing as nothing for sale and make a note never to buy anything from them.
