No Appeal Decission 50+ Days, what should I do now?

Hi, I used your standard letter to appeal a PCN from NPE online, they acknowledged my appeal by email at the begining of September, confirmed the charge was placed on hold while being investigated and said to allow 35 days for a decision. I still haven't heard from them and wonder what to do next, should I contact them again or just not worry that I haven't heard anything? Thanks

    Write to them stating that as they have failed to reply within the 35 days required of them by the BPA Code of Practice, you assume your appeal has been accepted and the charge cancelled. (If not, send a POPLA code - put this in, or leave it out as you see fit).

    This is what the BPA CoP says.
    You must acknowledge or reply to the challenge within 14 days of receiving it. If at first you only acknowledge the challenge, or your reply does not fully resolve it, normally we would expect you to seek the additional information you require from the motorist and accept or reject the challenge in writing not more than 35 days after the information required to resolve it has been received from the motorist. It is acknowledged that in exceptional circumstances, an investigation into a challenge may take longer than 35 days after such information has been received and in these instances the motorist must be advised accordingly and given a date by which they can expect a resolution. If this date cannot be achieved then the motorist must be written to again and a revised resolution date agreed. We may require you to demonstrate that you are keeping to these times

    Do not request the POPLA code
  • You could go onto their website and go through the pay process, stopping short go paying I might add. Some sites such as Smart Parking tell you if the alleged debt remains or has been cancelled.
