Bankruptcy because of family member

It's good to hear that the OR will go after your aunt, or at least speak to her (not sure there's anything they can do legally, unless your aunt defrauded her without her knowledge and it was reported to the police).
I think because so many people are aware of DMP's, and that seems to be the usual choice offered by advice services, there is an assumption that you won't be allowed to go bankrupt. But it's unlikely to be an issue for anyone if your assets are less than your debts.
And well done to your gran for letting you all help (I have been bankrupt for months and haven't told any of my family).
Actually she only told me, she does feel ashamed.
However that's because she didn't get in the debt and wouldn't owe the window cleaner more than £10!! SO this has been a big ordeal for her - just glad it's come to an end.0 -
Well done. It's always good to get that bankruptcy certificate in your hand.
Next instalment: Evil Auntie v the Official Receiver - should be interesting.
Yes very much looking forward to that, she can be a nasty piece of work.
Another question, i forgot to list vodafone as a creditor. Do you think the O/R will let me add this in, when we have the chat on tuesday?0 -

All liabilities owed on the day of bankruptcy are automatically included in the bankruptcy - even if you have not written them on the form.
Mention it on Tuesday and they will make sure a letter gets sent from them. Even if they did not send a letter you can send a copy of the order to Vodafone and advise them of the bankruptcy.
So pleased that your Gran has declared herself bankrupt and is hopefully free of this huge mess her daughter got her into.0 -
I am so pleased for your gran...as an older person I was the same never owed anyone a penny....until a cheating, lying partner ..now ex . took control and I lost everything.
My B.R was August 2012, I tell you this as my trustee is still trying to get him to take responsibility for all the debt and we did have a legal document holding him responsible.
So please understand these things can take time, although I felt the relief once discharged.
good luck xx0 -
Hi Luvchocolate can i ask did you still get discharged after a year considering similar circumstances?0

Unless special restrictions are applied to extend BR for things like fraud or non compliance with the OR - all BR's are automatically discharged 12 mths from the date of the BR petition - it'll fly by
(...sorry - didn't mean to butt in)0 -
You (or your Gran) also need to inform HMRC that she has been made bankrupt (they should ask for the Court Reference number).
HMRC will then close her old UTR (Self Assessment) reference number and may issue her with a new one.
With regards to appealing the Self Assessment penalties, provide as much information as you can to HMRC, the more information you provide the harder it will be to reject the appeal.0 -
Good morning, yes I was discharged after a year, my situation very complicated, I have a good relationship with my trustee and always been honest and done everything I could.
Great advice on here...good luck x0 -
Thank you all again.
HMRC are really annoying me, I sent a letter 30th December and they've not signed for it as Royal Mail have said they keep just 'taking mail' and not signing.
I've just wrote a letter to my MP hopefully they can help me get this tax issue resolved, bill is for 5k but they think my gran earned 34k as a pensioner - idiots!0
