Bankruptcy because of family member

Well done to your Gran for sharing the situation with you. That must have been extremely hard for her.
Reassure her that there will be something she can do to help her manage the situation.
Give her this number to talk to when you are not around: 0800 4 70 80 90. This is a free helpline for older people (the Esther Rantzen one).

Who in the family knows the situation? Have you spoken to aunty yourself?
Hi,
Thanks so much for your help, my gran only lives a stones throw from my house so I normally see her once a day for an hour or 2, if not every day it's every other.
The rest of my family know about the debt, but not the B/R option - they think my Gran still has savings. I've promised her for now we will keep that to ourselves until we've figured out what we will do (Going to have to keep my internet history hidden from Family!! :rotfl::rotfl::rotfl:)
I haven't spoken to my auntie, however there's a few developments.
My auntie is selling her house, it's just gone up, Zoopla (is this accurate?) shows the house was bought @105k in 2006 and is going up for 135k. Idk how much deposit was put down. Tomorrow i am going to visit her and explain i know what's happened (she is really good at talking the talk) my Gran wants to come too.
I expect she will say she will pay my gran back out of the proceeds but I absolutely do not believe her - is there a way I could make this water tight? If she was to offer I could make her put her money where her mouth is then.0 -
I find it disgusting this has happened and especially to her own mother. Hope you get it sorted.0

If you can get her to sign paperwork saying that she owes your Gran £X and will pay as soon as the house is sold/with a standing order of £X per month/or any other arrangement that suits your Gran, your Gran could take her to court if she doesn't pay up.
If you can record the conversation tomorrow, do that.0 -
A charging order against the house?
I think you are right not to believe aunty, but I would try not to show her that you don't believe her.
It may also be that your aunt has other debts in her own name.:heartsmil When you find people who not only tolerate your quirks but celebrate them with glad cries of "Me too!" be sure to cherish them. Because these weirdos are your true family.0 -
What bugs me she had an IVA in 2006 (roughly) The only thing she learnt from that was not to have debt in her own name next time round!0

Hi Whitewing, do you know how I could proceed with a charging order at all if it's for a personal debt?
Thanks,0 -
Is there any possibility of legal action/redress since your Gran was obviously coerced into supplying funds?
This is an awful thing to have happened and I do hope you are able to resolve things.0 -
There is nothing more likely to cause the breakdown of relationships than money...This might be be a difficult process and a tightrope will need to be walked between the pragmatism needed to deal with the your Grans debts effectively while remembering that whatever she has done, your aunt is still her daughter and your Gran will not be the first - or the last - to indulge a child with dreadful consequences. It will be an emotional roller coaster and you will all need to support each other if the family are to find a way out of this that doesn't mean the grandchildren end up paying the price of the debt and Gran can be at peace with it all. If vengeance creeps into the equation - it might get difficult for everyone. You sound like you are going to be a tower of strength for your Gran - fingers crossed for a good outcome :A0

Soooo... 2 months on and we are on our way!
My gran is much happier, i have got rid of all the cards, we are currently paying £1 per month to them, i'm managing all the letters for her so the stress has gone from her.
The car my gran had on purchase plan for her daughter is now in my possession and is being VT'd on Tuesday.
Soooo... Once i've got the bill for the car going back, it's done 12k miles outside of contract and has quite a lot of damage, I'll have all my grans Debts.
Gran's debts stand at 22k currently, she has £263 left over each month after all bills and everything else so i'll be filled in the 6.26 & 6.27 forms next week (they look scarey!!)
Stepchange have been great and have give me some advice, if my gran has £263 left over and £700(ish) minimum payments do you think they will let her go bankrupt?
Stepchange have confidently said they don't see a reason why not but it just feels like i'm waiting for something to pop up and say no!!
I can't wait to get these forms filled out and our appointment booked, want the rest of my grans years to be as good as possible for her!!0
