Hi guys
I wondered if anyone may be able to offer some advice. I had some financial difficulties around 2008/09 which are now cleared up. However a couple of credit cards I had at the time with MBNA defaulted.
Dont get me wrong, fully appreciate I am suffering now as a result of what happened in the past which is no ones fault but my own. BUT i was recently checking up and basically having a go at getting these removed early under the nothing ventured nothing gained rule.
The default on my credit file is 31/12/2009, I recently wrote to MBNA and they have supplied copies of the default notices which are dated 11/01/2010. From my interpretation of the CCA 1974 legislation (which may not be right) I think they have to write to me within 7 days of issuing the notice. Can anyone offer any further guidance on this and whether I have a shot of getting the defaults removed earlier on this technicality?
As I say, I'm no expert and may have got this wrong and but no harm in trying. If they have to stay on until they drop off on 31/12/2015 then so be it.

You can try but it probably won't do any good, the whole point of credit history is to show how people have managed credit in the past. They do off 6 years from the default date so if I've understood your post correct they will drop of on 11/01/2016.0

To be honest, I think its unlikely,
Credit to you for holding your hands up to it all but I think I would just get on with your life
and look forward to the 'drop offs'

It sounds like the date on the credit file is slightly wrong. It is likely that they did send you a copy of the default notice at the time and it is difficult for you to prove otherwise.
The most likely consequence is that they amend the default date, which will now mean that the entry drops off in Jan 2016 instead of Dec 2015.0 -
Thanks guys, as suggested I will leave it..worth a shot but knew it was a long one. As they are settled hopefully they wont be too detrimental the older they get and only and 14 months to go and I will have served my time. Thanks for taking time to post.0
