Iron broken within warranty, Ideal World wont resolve

I bought an Iron from Ideal World in Sept 2013.
I contacted them before the 1 year was up as the iron went wrong.
They duly sent a courier to collect and approx. 2 weeks later they sent a new iron - so far so good
On trying the new Iron, it doesn't work.
I got straight onto Ideal World, who kept stated it was now out of warranty. After I managed to get them to understand that my complaint was now about the new iron they sent as a replacement they are now saying that the warranty is from Sept 2013 and not when they delivered the new iron.
Does anyone know where I stand legally?
My view is that they still effectively have not honoured the original warranty, because all they have done is replaced the broken iron with a broken iron.

    I believe they are correct you don't get a new warranty it still runs from original date.
    Am sure some ones more knowledgeable will be along to confirm or deny.

    But must admit I agree, I'd be mighty hacked if they replaced a broken one with a broken one

    Yes it was the steam generator iron with the cork handle. I suspect you have a story to tell?


    The new one they supplied just throws out a load of water in addition to the steam. Its more of a steam/river generating iron.


    In response to another post, I read the sticky and the Sale of Goods Act, I have trawled the internet for an answer on this one. I cannot find an answer to my specific issue, where the supplier has tried to honour the warranty by supplying a new Iron, however that replacement is also faulty and now they claim that because the original warranty period is over its nothing to do with them.
  • I know the sale of goods act says different but 12 months out of that is good going.
  • Under the original warranty they need to put right the fault that was brought to their attention with the warranty period.
    Their first attempt failed but I would write to them giving them a final opportunity to fix/replace, after which I would small claim.

    IMHO there is no way they are in the right here.

    The warranty is a red herring as your legal rights come from the Sale of Goods Act. I don't deny that they are offering terrible customer service, but legally they don't have to offer any warranty at all. That doesn't meant it is ok for the replacement iron to be broken though.

    If the iron is inherently faulty then they must repair, replace or refund you. The refund can be partial to account for your use of the item. However since it is more than 6 months since you bought the iron they can require you to prove the fault is inherent.

    And note that the 6 month period starts from the original purchase, not the time it was replaced. Legally they are the same iron as far as the Sale of Goods Act is concerned.
