Out of hours call used in disaplinery meeting?

A friend at work has been called i to a disaplinery meeting over a few thinks. One of the points in the letter is a out of work hours phone call with the foreman(who brought the disaplinery) where my friend told him,
"Iam at home you pri*k"
Then the foreman hung up.
In the letter it states what my mate called him but it doesn't mention the abuse he gave my mate first,which he has whitness to which are willing to back my mate up.
Can a out of hours call be used in a disaplinery hearing?thanks.

    How long has he worked there? And why the hell did he call him a pr**k...utter madness.

    Around 8 years.
    The foreman was lot more abusive using words a couldn't type on here which caused him to call him a pr**k. He phoned to give him a telling off about something that my mate had nothing to do with. But to be honest the foreman has had it in for him for a while and just wants shut off him. He has basically been bully my mate hoping he would find a new job. Some of the things he said to him.

    Pass your car test or you have no future here(doesn't need a licence for the job)
    While your on hoilday spend some time looking for a new job.
    It's all abit rubbish really since the foreman got promoted he's employed all his mates ect and if your not in his "inner circle "
    He gives you a hard time. Iam lucky as iam out on site most of the time and the foreman has no control over me.

    There was two other people standing by the foreman when he made the call. I think there just trying to get rid of him as there's other points in the letter which are really pety and have no context. At the end of the day it's his word aginst the formans and as most off the workforce and most of the bosses are all mates with the Forman so it isn't looking good.
