Faulty goods from ebay

I purchased an iphone 4s from ebay at the beginning of August. After a few weeks it had a fault and I returned it using the warranty and it was repaired (I paid the return postage special delivery). Last weekend it developed different fault (seller previously responded on the same day and communication was good) and the phone will not work at all, so I contacted the seller for a refund. The seller hasn't responded and I can't find a way of contacting ebay to resolve this. Paypal won't refund because the purchase is over 45 days old, and I can't claim on section 75 on my credit card as I paid via paypal.
So, can anyone tell me, am entitled to a refund, and how I go about it? Thanks in advance.

It's a business seller.
I didn't want it repaired again because it cost me £8 in return postage, and this will be the second return within about 8 weeks. I appreciate that it came with a warranty but I've no idea if it will break again and if I'm being truthful I'm not happy at shelling out every time it needs to go back.0 -
You're not entitled to a refund, the seller can repair, replace or refund. You can request one of these options, but they don't have to oblige if the option is disproportionately costly.
Basically, if they want to repair they can do. You shouldn't be paying the postage though.0 -
I see what you are saying Mattyprice4004, however the seller will not repair unless I pay return postage, if I return this time it will have cost me £16 on top of the price I originally paid. Ebay won't help, I'm not covered even though I used a credit card because ebay insist on paypal, who also only allow you to raise a case for 45 days. The Sale of Goods act clearly says I shouldn't be out of pocket and the seller bears responsibility but there is nothing I can do to enforce it, and it's irritating me! I do realize it's not a huge amount of money but it's the principle. Thanks for all the replies, appreciated.0

Hang on - did you pay using Paypal, or did you give your CC information to PayPal?
If you paid via CC, using PayPal as the processor, then you can raise a S21. PayPal might close your account for doing so, but it is possible.
If you paid via PayPal, or you used your PayPal account funded by a CC, that's more complicated.0 -

Did you pay using YOUR Paypal account (funded from your CC)? Or just pay to HIS Paypal account via CC?
