We received the initial letter after we had left the UK on Holiday. We had three by the time we returned.
My problem had been the machine would not accept our personal registration, we were there only 90 mins having an anniversary meal at The Fish House.
I and my husband who had been the driver, but I am the registered keeper, read through all your long letters and information and decided to go your route.
We sent the first letter, which did not get an acknowledgement, but we then received the Letter Before Court Case, so again, came back to your information and sent off the other templated letter, changing more to my words as suggested, I also copied my first letter again, and I did state that I would take it further to the SRA and included the Appendix
We posted the letter 21 October, and today received a letter stating that "this Charge has been cancelled as there is no outstanding payment due on this account"
Now I suspect that this letter was due to the earlier one, as although I live only 7 miles from Fistral, the post isn't that quick as their letter is also dated 21 October.
Thank you so much for your efforts and helpful information in helping us sort this out.
The Fish House will be the loser, as we will NOT be going there and having to pay in this car park....

Not what we had wanted to arrive home to, but having read so much about ParkingEye I would happily have paid them the cost of the parking, but it was their machine that didn't work.

Well done! Remember that the keeper could have named the driver to have rewound the clock right back to PCN stage and then the driver would have won at POPLA. Works as an option with PE postal PCNs (any ANPR PCN), so one to remember for next time if the keeper can't appeal in time and it's a postal PCN.
But it sounds like you threw a couple of clear forum template strong appeals at them and they knew they'd rather not fight you in court! Thanks for the update.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I would strongly advise you putting this in writing to the Fish House. The best way to really beat PPCs is to get their lifeblood cut off. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
