CENTRAL HEATING ETC.
(a) The Seller undertakes that any systems or appliances of a working nature (including central heating, water, drainage, electric and gas) forming part of the Property will be in working order commensurate with age as at the Date of Settlement.
(b) The Seller will make good any defect which prevents any system or appliance being in such order provided said defect is intimated in writing within 5 working days of settlement. Failing such intimation, the Purchaser will be deemed to be satisfied as to
the position.
(c) The Seller will only be responsible for carrying out any necessary repairs to put any system or appliance into such order and shall have no liability for any element of upgrading (except to the extent such upgrading is required to put any such system or
appliance into such order).
(d) The lack of any regular service or maintenance of any system or appliance or the fact that it may no longer comply with current installation regulations shall not, of itself, be deemed to be a defect.
(e) The Purchaser shall be entitled to execute any necessary repairs at the expense of the Seller without reference to the Seller or the Seller’s tradesmen (i) in the event of an emergency; (ii) in the event that the Seller’s tradesmen do not inspect the alleged
defects within 5 working days of intimation; or (iii) in the event that any necessary repairs are not carried out within 5 working days of inspection.
(f) The Seller confirms that he has received no notice or intimation from any third party that any system (or any part thereof) is in an unsafe or dangerous condition."
Yes agree to that. and this is what the purchaser was claiming for a new boiler.
But last night me and my Gas engineer got access to the house and my engineer had to fix the mess that the purchaser engineer had coused.
My engineer got the boiler running in 20 min did the test and gave the gas safe certificate in less then 30min.
It cost me total £100.
The funny thing was then my engineer was working on the boiler the purchaser says to me that they want to put a new boiler and they are ready to pay half if im ready to pay half for it.
My answer to that was: Im very sure this boiler is working.
Now i have the copy to prove it and on monday i will send it to my solicity
I was so stress out but im ok now :jWhat happens if you push this button?0 -
I'm glad you got sorted. If that's what the law in Scotland is though, I would be getting the gas engineer report and service done first rather than giving the purchaser any chance to claim. Covers everyone.
We are selling in England and got a service and certificate done once we went on the market so we could assure buyers that it all works.Father Ted: Now concentrate this time, Dougal. These
(he points to some plastic cows on the table) are very small; those (pointing at some cows out of the window) are far away...

Ya i should have done it in a first place but when i saw the home report which said everything was good. i did not think of getting a engineer report also.

Problem is, unless you get it done as you move out, the buyer can still say the boiler broke down the next day and have an incompetent repairman. You'd probably have to do the same thing. Fortunately, although it was a combination of an incompetent engineer and wishful thinking on the buyers part.., the cost was minimal to you (although of course you shouldn't have even incurred that).0

Agree. but i think as the buyers were too greedy so their incompetent engineer to took advantage and charged them £150 and gave them CORGI report which i have been told by 2 engineers that its not legit as its now called GAS SAFE.What happens if you push this button?0
