Damaged display items

I'm not sure how I feel about this one, I hate being ripped off or had one over on me, but it isn't a major issue....
I brought two sofas from harveys furniture store, very nice, comfy, the sales and delivery where spot on.
The sofas where reduced as they where display items and the store was pending a refurbishment, I haggled another reduction on top of it and a reduction on delivery, bringing them both under £500.
However after it was delivered I notice that one of the back leg was loose, clearly damaged, in fact barely hanging on.
It doesn't affect the use (and i'm sure that if not moved it will be fine..) but it is a little annoying, I didn't pay a reduced price because it was damaged.
Would you speak up, or let it go?

what is the right with display items? sold as seen comes to mind but the damage (if it was there in the store) was inaccessible.0 -
There is no such thing as sold as seen when buying from a business as a consumer.
If they had pointed the damage out to you prior to purchase it would be a different matter. Or if you were invited to carry out an inspection that ought to have revealed the fault, that can change things also - but it doesnt look like thats the case here.
Contact harveys and (if you're happy with the suite apart from that) just explain you're willing to keep it if they send someone to repair. In my experience retailers are usually more than willing to do this - especially as it saves them having to collect it and try to resell etc.You keep using that word. If they can fix it to a satisfactory standard, I wouldn't have a problem.
What that poster is asking (i think) is "if they refuse a repair and they are only offering a refund, would you take the refund or keep it as is and have it repaired yourself?"
Technically you can't enforce a remedy that is disproportionately costly or impossible.
I dont think that will be the case here. The reason being if they want to refund it and then resell it as is, they'll be losing the initial delivery costs along with the cost of collecting it on top of perhaps having to sell it for a slightly lower price and also storing it.You keep using that word. I would expect them to honour the repair work, or a partial refund to more than cover the costs of a repair, organised by myself.
Depending on the amount refunded and quality of repair, either would be a feasible option.
If neither where offered, then they can come and get their sofa and give me a full refund.0 -
