As a buyer though you can at least put in a protective claim at 44 days to beat the deadline if you don't have the item or a tracking number, sellers kind of expect that which is why so few will use surface mail. The when item does come just cancel the claim.

I don't think I have actually come across anyone using surface though for international items for ages, probably since the US postal system changed.

Hiya! I had a similar problem where as buyer claimed she did not receive the item...she was coming up with loads of stories, constantly changing her story etc. I had offered recorded delivery before posting and she refused. I sent her proof of postage certificate recorded delivery and she still filed a claim. They took the money from my paypal account (which at the time was zero) so it was negative so next time I wanted to use it I had to cough up the money to make it positive! Paypal said I couldn't prove that she had received it and I said they cannot prove she hasn't got it...so now everything I sell no matter how small MUST have recorded delivery.

Proof of postage is not the same thing as proof of delivery, as you found out

kebab...there are dozens of threads on here about paypal, whether good or bad. However, you must understand how to use it before you accept it and as both you and fay have pointed out proof of postage is not the same as proof of delivery so it was fairly obvious you would lose a paypal claim.

Recorded doesn't do a lot really and isn't worth the extra 70p, in fact for me that extra 70p would make the difference between my items selling and not so I don't add it. If a buyer claims non receipt I claim my losses back from the RM and refund promptly, through gritted teeth if necessary, but I certainly would never allow it to go as far as a paypal claim. If I believe I have a dodgy buyer, and there are relatively few who will try the non received route, then just mention it when you leave feedback..leave a postive along the lines of 'sorry item lost and money refunded', then that should be enough to stop a buyer doing this too often!

They would have taken the full payment originally made including post and packing, as per their terms and conditions.

It can be more - if you do not upload money promptly to replenish the negative balance, they will transfer the money to a dollar balance (at their usual poor rate of exchange) and add an administration charge - can't remember how much that is, it's in the t&c somewhere though.
