Merchant refusing to cancel order

Hi all. Just over a month ago I ordered a spare part for a computer from a website. The website appears to be based in the UK (there is a UK address, phone number, VAT number etc) and it looks reasonably legitimate. The website showed the item as being in stock imemdiately, and payment was taken from my credit card at the time of ordering. The payment seems to have been processed by a third party (moneybookers).

Long story short, I've been waiting a month, still haven't received it and would like to cancel the order and buy from elsewhere. I have emailed them twice asking to cancel, and they just keep replying saying that it will be in stock soon.

I have sent them a very firm email now asking that they cancel the order or I will take it up with my credit card company. Does anyone have an words of advice? I'm worried I might not be covered by section 75 as the item was £75 + £10 shipping + VAT = £102.

    You are certainly not covered by Section 75 of The Consumer Credit Act.

    However, non-delivery is a valid reason for a chargeback.
    Did you get a delivery date around the time of ordering?
    If not, send them an email stating that you will expect the goods within fifteen days from now or you will seek a chargeback from your card issuer.

    If the goods do not appear within that timeframe, speak to your card issuer about a chargeback.

    It was supposed to be delivered in 7-10 days. It has already been 30 days. I don't want the item any more full stop. I already ordered one elsewhere (I now need it quite urgently). Can I already do the chargeback now?

    Yes you can. Speak to your card issuer.
