PPC not using POFA 12 - advice pls

Advice please....
if a PPC hasn't gone down the POFA 12 route, and only sends a Notice To Owner, how is it that they can only pursue the driver for a PCN? Just want to clarify who legislates this please?

In simple terms, contract. There is no legislation in respect of this as the law of contract is based in Common Law.
Only the parties to a contract can be held to the terms of it and as only the driver at the time is a party to the contract (if that does in fact exist) then the owner has no liability.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
