Just gets worse and worse! Joint mortgage

Hi all
I have posted here a few times before regarding my situation. After coming up for 2 years, i still have a house with my ex boyfriend. He lives there, I moved out last August. I continued to pay the mortgage until April of this year when I decided that enough was enough, and he was to pay it. Well he never paid again, and now the mortgage is 6 months in arrears. He also is now unemployed. We got a letter from the bank saying they were going to start legal action at the end of this month. He has told me that he would buy me out but that all fell through when he left his job. My solicitor is next to useless really, and just writes to his every other week to find out what is happening. Well today i just called the bank for something else, and they happened to tell me that my ex had called them last week, and that our account is now on hold and legal action is not happening, because he is waiting on confirmation of his benefits! Apparently., they are going to pay the interest on hte mortgage and my ex will have to meet the shortfall! To be honest, I'm absolutly livid about this. Not only is this going to take even longer to deal with, (until he gets another job, or doesnt make the short fall and legal proceedings start all over again..) or until he gets a job and a mortgage approved to buy me out. Why should i have to wait on this happening? I just don't know what to do. I didnt even know that you could apply for benefit for a mortgage!

To be fair to your solicitor what do you expect him to do. You are the client and the solicitor will follow your instructions. The solicitor has no powers at their disposal other than the law.Why should i have to wait on this happening?
Perhaps because this isn't just about you. Relationship breakdown brings with it unforeseen complexities. Welcome to the roller coaster called life. All you can do is deal with the situation as it stands. Meanwhile get on with your life as best you can by working around the obstacles. Deferring plans to a later date.0 -
Well i have actually been instructing my solicitor all along. Every time i phone they are not there.... My original solicitor went off sick some time ago, and my case just seems to have been left.
Roller coaster called life? Yes, I do realise that. I'm an adult and have had other things to deal with in my life. The reason that i am so annoyed about all of this, is because I have waited almost 2 years and was told that i would get bought out. My name is still on the mortgage and this is affecting me as i'm stuck at my mums until i can get out of this situation. Things arent; always as black and white as they seem- but thanks for you reply !!!!0 -

This was always going to end up in repossession if the advice in the above threads was not actioned.
This debt is your responsibility whether you live or not, pay the mortgage or you don't, so either let it get repossessed, which will trash your chances at getting another mortgage for a while or negotiate with the lender and bring the arrears upto date and keep paying the mortgage and let your ex live there while its sold.

Have you instructed your solicitor to apply for a sale of the property? Or alternatively are you able /. would you want to buy your ex out?All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0
