UKCPS PCN for leaving the site

Hello, I hope you might be able to help? I have done some research on the Newbie thread and quite concerned of ignoring a windscreen ticket given by UKCPS for leaving the site.

We were given a PCN for leaving site but were on the site having eaten and gone bowling, having come back after bowling (its my sport I play) we found this PCN. We went to the security office saying what is this about as the ticket say the car was first observed an hour later since we arrived (and eaten) and then 11 mins later we left the site. The driver stayed on the site and the passengers left. The issue is that we can't get a computer generated receipt from the bowling alley as its a league which uses a group booking. So being given a £60/£100 charge for using the site for over 4 hours is very unfair.

Do you think we should wait for the postal invoice (as the ticket doesn't say anything about VAT)? The signs were half way up a lamppost and impossible to read while driving in. Plus how is have we caused £60/£100 worth of loss? Any kind words or ideas would help put our minds at rest.

Just read the Newbies thread, UKCPS often gives in when faced with the standard first appeal.

You could enhance it to state that (i) the driver remained on-site and the passengers left (ii) neither the driver nor keeper can be held liable for the actions of the passengers (iii) should they continue with their baseless claim you will put them to strict proof that the driver left the site and (iv) by observing people leaving the site but failing to warn them not to UKCPS failed to mitigate its alleged losses.

Yes. As per the Newbies thread. Then send the template appeal and UKCPS will crawl back under their stone.

Hi, Thanks for the posts, may I ask what is the reason to wait for the 28 days? We think that perhaps we should get the letters sorted now while its fresh and then wait? But something does keep telling me in my head just to send the appeal now so if it came to it get to the POPLA stage quicker.

Because you would throw away the appeal point that a keeper has, that the Notice to Keeper is not compliant so there is no keeper liability. WAIT for the NTK.

  • So its been just over month over now and we still haven't got any letters through the post, but just getting all the letters ready if and when it happens. Doing a bit of research I have noticed that UKCPS are no longer under POPLA (although there website still states this) and are now part of IPC and we didn't take any photos of the signs because I haven't been back to the site (honestly scared to do so). Does this mean that we should of paid the £60 to begin with or should I run and catch a train just to take some pictures incase the signs haven't changed?

Also if it takes longer than 2 months does that mean the PCN is cancelled, but what happens if it gets lost in the post the last thing we want is bailiffs - this is the first time ever we have got a PCN and don't want it to affect credit scores or having to go to court. Although we still believe that spending 4hours in their while eating food and bowling the PCN is very unfair!

I suggest you go back and read the newbies thread and stop panicking about a scam invoice. You certainly have not got to grips with the advice if this is your reaction, and you are playing right into the hands of the scammers.
  • "IF YOUR 'PCN' IS FROM AN IPC AOS MEMBER PLEASE START A NEW THREAD WITH PHOTOS OF THE SIGNS ANDTHE PCN/NTK AND DON'T SAY WHO WAS DRIVING. "

Hence why I have updated my post, UKCPS are now a IPC AOS member - but the PCN states POPLA so which category is this under? As I don't have any pictures

The ATA at the time of the parking event will be the one appropriate to the case. You will be dealing with UKCPS under the BPA/POPLA banner.

Seems to me you await further communication and demand to see photograph of driver leaving site. If they have any photos of the people leaving, I am sure you won't be in any pictures if you didn't leave.

Also worth asking if it ever gets to IPC?POPLA stage for a description of the person in question that is alleged to leave site.

And have a read of this case, to give you some understanding of many issues related to 'leaving the site'.
