Lloyds TSB - repaid charges

Amount repaid: £2784.04

I have been pursuing this claim for several months. LLoyds TSB paid £750 as a "without prejudice" payment but it has taken several weeks and threatening letters to take them to court via the Online Moneyclaim service for them to cough up the rest. They have deducted the £750 they have already paid from the Moneyclaim but I had already taken it off the total owed. I refused to accept their offer but they have paid it into our bank account today anyway. I have a court date of 6th September. Should I continue and try to get the rest or not? They said in their latest letter that it was in "full and final settlement". I wrote back to their solicitors explaining their error but they have paid it in regardless. I sent their solicitors all relevant documents (interest calculations etc) to explain their miscalculation, but they still got it wrong. Any helpful suggestions?

Don't touch the money they put in your account! Tell them that you do not accept it as a final settlement, and that if they make any further claims that it is a 'full settlement', they may be 'Preventing the Course of Justice', and that it is considered a criminal offence. Make them aware that you will be taking them to court if they are not willing to offer the full amount you have requested. You do still have a legal right to take them to court to get the rest.
