can i get a refund???

hi
hopefully someone may be able to help me.
i have been searching for a mp3 player for a while now and i managed to find one which i liked on https://www.aria.co.uk
once i got it home and transfered music on to it i wasnt happy.
not with the sound or anything like that it was just that when i transfered the music on to it it went on in a random order. i couldnt get the tunes in order as they were on the album.also you cant put each album into a seperate folder and play an album at atime you have to scroll all the way through to the track you want which could mean scrolling through 70 or 80 tracks to get to where you want.
i know there not major problems but i feel its not exactly what i wanted.
ive looked at the terms and conditions on the web site and from what i can gather i think they will only offer back a credit note which would not be any use to me really.
does anyone know if i would be entitled to my money back or would i have to accept a credit note.
i know i probably sound stupid but i feel really let down for what i bought.
any advice will be greatly appriciated

    Google Consumer Protection (Distance Selling) Regulations 2000

    There are certain regulations about buying goods mailorder/over the internet which give you the same rights as if it were bought in person. I don't know the precise details but it's worth a try. Quoting "distance selling regulations" in your correspondance with customer services may help your case. There is a time limit, so don't hang around.

    My understanding is that you are entitled to a refund (or, at worst a credit note) if you return it within a certain number of days (usually 7). However remember that you must bear the cost of return, you will not get back any P&P you have already paid and some companies will charge a re-stocking fee (which can be as high as 25%). This is usually to cover the supplier checking to ensure everything is present, it has been correctly initialised and replacing certain parts (in the case of an MP3 player the ear pieces may have to be replaced for hygiene purposes - this may even be a reason for not allowing it to be returned). The restocking charge also covers loss should the item have to be sold as second hand.

    Talk to the supplier and determine their policies.

    Try looking here for more advice.

    As pointed out already, you can get a refund (for any reason) if it's within 7 days.

    If you are outwith the 7 day period then I doubt you would have the same rights to an automatic refund as the player isn't actually faulty - it just doesn't suit you. I suppose it all depends on Aria's T&C's.

    You should really phone soon them to clarify.

    i also found somthing else out
    i was just checking the item description and it says it has folder support also it says it came with a strap which it didnt.
    i actually went to the actual shop to buy the item because it is quite local but at the shop they woulnt let me open a box and look at it because they were sealed.
    in hindsite i should of havnt have bought it.
    anyway i off back down to shop later to see what they have to say.

  • i took it back to the store and they argued for ages untill i got the website up and showed them the description..and even then they wanted to charge me 10% adminisration fee for taking it back!!!
    errr no .. i dont think so

    got full refund anyway in the end took me 1 and a half hours!

    the main thing to remember is that all goods 'must be fit for purpose' and i think that the only time you are 'entitled' to a refund, is if they are not. if you did not read the description properly (i dont myself sometimes until i have a problem and discover its a 'feature') then you have to rely on the goodwill of the shop
