Advice re: deposit refund not received.

We booked someone to come and serve a hog roast at 5pm at a party in August. On the day he emailed to say that he was running behind and could he serve at 6pm instead. Then he telephoned, at 3.30pm, to day he could not serve until 7pm or maybe even 8pm. He asked what we wanted to do and we cancelled him coming as most of the guests with young children would have left by then. He said he would return our £150 deposit.

I provided him with my bank details for the return of the deposit later that week. He has not refunded. I have emailed him and texted him and he does not reply. If I ring him he hangs up on me.

I have emailed him to say that I will take legal action if I have not received my money by October 31st.

Is my next step to go to small claims court? Or are there other steps I should be taking?

    Send him a letter before action, I'd hope this would be enough to push him into action.

    and retain the texts and emails that you exchanged re the refund as this will work in your favour should you have to escalate to court (ie you can show that a refund was promised)

    For more information regarding a Letter Before Action I suggest you google 'money claim online'.
