County Court Claim Form - Parking Eye - HELP

I have received a County Court Claim Form from Parking Eye.

The facts:
- I am the registered keeper of the vehicle
- I have not received any other letters from Parking Eye other than the Claim form (i.e a letter before action / before County Court
- The issue date on this letter tells me that I was actually in a different town that day.
- I have filled out the acknowledgement of service to extend my reply to 28 days
- The car park was free parking

I am trying to put together my defence and was hoping for some advice from anyone willing?

    You don't have 28 days from the acknowledgement, remember. Only 28 days (plus service) from the date of the court papers.

    Please read the link already given, it's everything I could think to collate for people who have got a Court Claim from a PPC. Make sure your signage point mentions the fact Morrisons signs are yellow and black, same as PE signs. But there's loads more to include in a defence summary.

    And lots of cases are being stayed for the Beavis case ( now (or for POPLA instead if you strike really lucky with your local court!). Read the link and all links within it, and read a LOT about the Beavis case going to the Court of Appeal as that will be key. The links show you everything including how to complete the N180 DQ in due course and shows you loads of cases won v Parking Eye.

    The fact you weren't driving does help your defence but ONLY because you can say PE failed to serve a Notice to Keeper to you so there cannot be any keeper liability (one of several defence points for this stage). Show us the draft here, there is no need to hide. PE serve thousands of court papers every year now.

    Also complain to Morrisons Head Office by email (as discussed on LOADS of PE Morrisons threads, search this forum for the store's name to find them!!) because that will get PE writing to offer you a settlement if you pay £60. Carry on complaining to Morrisons if so, don't pay PE £60 unless you really can't face the paperwork needed to see this off (hopefully). Amongst all this complaining do NOT think the claim is on hold; it is NOT even if PE quickly send a 'without prejudice' offer letter.

    Your priority is your defence and it can be put together just by reading the links in post #5 of the newbies thread, including the Prankster's Guide, one of the links.
