partner changed the locks

i was living with my partner and our child who is nearly 3,in a mortgaged house 50/50.we have had a few rows,and while I was at work she changed the locks,thus me being locked out .I tried to talk to her to no avail,the police were called,and they said to me I have no legal right to be in the house,and also said if I had changed the locks it would be her on the outside ,and nothing she could do.what are my options about getting back into the house legally.

  • That's a load of rubbish. Break into the house. The police can't arrest you as you have every right to be in the house as it's 50/50. That's if there isn't a restraining order on you or anything.

    Call a locksmith and change it again although something will have to be resolved as she can then change them again!

    Just to clarify, do you and your own the house 50/50? Or do you pay her money towards a mortgage in her name only?

    there is no restraining order,and I have been told by the police if I broke the door down I would be arrested as the door is not completely mine

    Although you legally have a right to enter the home it is obviously not so easy as this. The police are not trained in matters like this - it is a civil matter.

    You do not want to make the situation worse particularly as there is a child involved.

    What do you want to happen? Do you want to return and work things out? Do you want your partner and child to leave the house? Do you want to pick up your belongings and personal papers?

    Put aside the rights and wrongs of the situation. Things will get ugly very quickly.

    Everything will have to be worked out between you and your partner eventually. This may involve talking to each other/mediation/court action.

    Let things cool down for the time being. Have you a friend who could mediate with your partner so that you can collect some things from the house? If not, the police will accompany you if you tell them the situation. Arrange a time to collect your things and then give it a few days and then when things have calmed down start talking to your partner.

    If she refuses to cooperate then I'm sad to say you will need to get some legal advice.

    Usually in these situations time is a healer. Don't rush in and do something you might regret. Remember your child who is caught up in all this.
