Strange return/refund cases - help!

Hello all, I've quite recently begun to sell a collection of rare music cd's on ebay due to relocation/space. I've sold a handful so far and all has been okay but two recently have come up with problems and I'd be interested to know how people think I should proceed.
1. CD sold. Item sent to buyer. Buyer decides they would like to return the item as it's not what they wanted (item description states that it is an unofficial live cd release and therefore is not the usual exceptional sound quality). Buyer has sent back item in the original cd case but has sent back a blank cd. Where do I stand with this?
2. CD sold. Item sent to buyer. Again, buyer decides they would like to return item as it's not what they wanted. Claims they have sent it, I have yet to receive it a week later (now I know to account for RM delivery times/delays etc) but now I'm confused. If I never receive the item, I therefore would not have to refund and they would have to claim it back from RM themselves (assuming that they have a proof of reciept, am I correct?)
As I say, on the whole the sales have been fine. I'm just concerned that because these are rare CD's, people are taking the michael and returning rubbish or just having the option to make copies of the CD's and then returning them?
Hopefully this makes sense :T
Both cases are currently in limbo until I work out what to do with these, it's very frustrating.

1. Did they buyer sent it back tracked and have you asked him about the blank CD yet?
2. Don't refund until you have received the item back...0 -

Re number 1 - by 'unofficial' do you mean pirate? If so you have an additional problem in that this should be destroyed rather than returned.

Not pirate, they're unofficial live recordings. I wasn't aware of an issue with them as I've bought them previously at record fairs and from music shops....I see.0
