Parking eye letter before county court claim

Hi all,

I forgot to pay at a services in July after avoiding an m6 gridlock,
Sat in the services for 3 hrs and got a ticket as a result...

I have appealed independently to POPLA and it was rejected. I realise this has been asked before and I have tried reading through all the info but i'm still not sure what to do now.

The letter I recieved was dated 2 days before I recieved it dated 7th October so I only have a couple of days to choose what to do.

I have a good credit rating so I am not sure whether to just avoid wrecking it and just pay?

Any adivce you can give would be greatfuly recieved......

    Read the Sticky thread for NEWBIES which will tell how you to beat this. There is plenty of info about parking lie and court. Nothing will affect your credit rating unless you lose in court (you won't if you follow MSE advice), don't pay.

    What a terrible waste of a POPLA appeal - guess you've seen PE never contest our version and we always win. You came here a bit late, unfortunately.
    I have a good credit rating so I am not sure whether to just avoid wrecking it and just pay?
    Why would you do that, seeing as even if you lose at a hearing (which may never happen) you don't wreck your credit rating nor even get a CCJ on your record, if you then pay straight away? May as well fight it, seeing as the amount isn't much different.

    Get reading of ALL the blue links there from post #5 of the newbies thread - and read them again as you get each stage of the paperwork if they do try a small claim. Learn about the Beavis case and you may get your case stayed for Beavis if you ask at the right time (all covered there). But as you only have a LBCCC now is the time to complain to the Services Manager about this 'intimidation of a tired driver taking a break from a busy motorway for safety reasons'. Be assertive enough and maybe it will be cancelled - NOW is the time to try seeing as you don't have court papers yet.

    Also read the LBCCC Fightback thread (in Crabman's parking forum stickies) which tells you how to respond robustly to a LBCCC.

    Ok, since my last post I have sent parking eye one of the defence letter templates. They have acknowledged receipt via letter and have informed me that the claim is still being pursued through the court and that I will be liable for all further costs....

    I have not contacted the services manager yet .....
    I have found the address on the website for the services shall I address the letter to the Services Manager? Should I ring and ask for the magaer ?

    If that fails what is the next step??

    What do I do if I get a Court date through the door ?

    Of course - would you rather face a court hearing than have a phone conversation to get it cancelled?!

    I don't know what you mean by 'I have sent parking eye one of the defence letter templates'. There are appeal templates for use for POPLA (i.e. prior to any court claim) so do you mean you sent an appeal?

    Or that you read the 'LBCCC Fightback' thread at the top of the forum and sent the suggested response to a LBCCC? If you haven't read that sticky thread, you should have done because it's the one for the letter you say you got! It's one of the stickies collated by Crabman in his 'parking forum stickies' near the top of page one. No link, it's right there near the top.

    Have you got court papers yet? You don't just 'get a court date through the door' you get court papers first and you defend to the Court, initially. If so you need to send an acknowledgement online via MCOL and then submit a defence (not an appeal) to the Court, as per this advice:

    Clarify please what stage you are at. But if you are not yet at small claims papers stage then read the LBCCC Fightback thread urgently and robustly respond to PE and get complaining urgently!

    So basiclly I'll explain I genuinely forgot to pay for 45 mins over stay and now I am being harassed for £100.... I guess the manager will get these calls everyday and just tell me to get lost no ? I was in the starbucks drinking coffee for the whole time can the coffee shop manager help ?

    Ok so far I appealed to POPLA with my own letter (stupid i now realise). The appeal was rejected. I then got the before county court claim letter and responded as reccomended by the "parking prankster" website with a 'letter of defence' template
    (I used the free parkng letter). Since I sent that letter I have had a letter from parking eye saying that I still owe them £100 and that my appeal has already been rejected by POPLA.

    So Basically I think I have done the LBCC fightback ?? I've given a robust defence with the relevant legal jargon....

    I have not had any court papers yet but I suspect they will arrive anytime soon. Now I know my credit rating wont be affected I have decided to fight this one to the death rather than go down without a fight and surrender to thosse robbing scum!

    So the next step after ringing the servuce station manger is ?

    I havent offered them a settlement yet ? should I do this i'd pay 20 quid to get this out of the way!?

    No - do you really want to include the name of the driver, and an admission, in one fell swoop?! No, you say 'I am being harassed for £100 and apparently 'the driver' stayed longer than a time limit that can't have been clearly communicated. I have read about these fake fines online and read that you may be able to cancel it or accept £10 or so, if there has been some sort of loss caused to Welcome Break. I am asking you to cancel this. (etc.).

    No saying who was driving, get with the plan! You defend it and complain as registered keeper.

    PE won't accept £20 so forget that. Have you read the LBCCC Fightback thread? It does NOT tell you to offer £20 or anything to PE does it...? Read it.

    Just received a claim for from the county court!

    Unfortunately I haven't done anything since my last post.

    Not sure whether just to pay up now £175 as I will incur more costs if I dont !!?

    Do I have to pay more if i Lose the appeal?

    Have you any intention of going back and reading the stickies properly AND DOING SOMETHING this time?
