Missed POPLA deadline appeal for B'ham airport PCN

Hi apologies if this has been covered. I have spent hours going through the threads and cannot find an answer. Briefly my husband dropped me off on a sside road at 6am in the morning at B'ham aiport and APCOA want the usual £50 going up to £100. I did initially complain to them but they rejected it. I then ignored it and hoped it would go away which I realise I shouldn't have done. Now I've had a debt collection letter for £135 and I have gone over the 28 day deadline for POPLA. Some have said in posts this doesn't matter but the POPLA site seems quite firm on this. HELP!!!

    You can safely ignore debt collectors as they have no powers whatsoever. The NEWBIES thread tells you what to do if you have missed the PoPLA deadline.

  • I definitely have been on the computer too long as I can't find it and I've read the whole NEWBIES section.
  • I looked at one of the links under this section and it stated that POPLA don't set deadlines but their website says they are very strict on the 28 day deadline?? Very confused.
  • The thinking seems to favour the idea that no PPC will be stupid enough to take this sort of case to court because airports are covered by by-laws. I'd suggest writing to APCOA stating that under the relevant by-laws they have no authority to scam you and any further attempt will lead to a small claims case against them for harassment. Show them that you aren't the usual gullible sort of victim they thrive on.
    Also remember that stopping is not parking.
  • Should I try going through POPLA too? I get the impression that APCOA will just ignore any letters I send. Sorry but I'm at a loss witht the legal stuff -are there any templates / examples on here I could use to write to APCOA. Thanks!
  • You cant go through POPLA as you have no code, however there is a company out there who can deal with this for you , for a small fee.
  • I am not home at the moment but I think I may have a code on my letter from APCOA after my first challenge. If I have a code and appeal what are the chances that POPLA will look at it with it being over 28 days?

    On the other hand, you could read then POPLA decisions thread in the stickies (working back) till you find an argument that has won for APCOA cases based on "No keeper liability". See Prankster's blog here relating to Luton Airport http://parking-prankster.blogspot.co.uk/2014/03/apcoa-admit-luton-airport-fines-are.html

    Not 100% sure that B'ham is under statutory control, but if it is, then do some googling for any cases with this PPC and airports.

    Same as here, you are too late for POPLA - no biggie, so what? What do you think people did 2 years ago before POPLA existed?:

    No-one cares about DRP and Zenith letters - please just search this forum for 'Recovery' or 'Zenith' and get bored reading the umpteen thousand threads wasting their time talking about those letters. ''No they can't'' is the answer to any question about debt collectors. Please do the search of the keywords I have suggested in bold.
