  • Well, let's hope so. The hearing was notionally yesterday, but I've had no indication of any result as of yet. But maybe the infamous delays in posting to Cornwall (re: JAS's inability to get the evidence pack to me) are at the heart of it.

    I'll give it another day, then email POPLA for any progress. In fairness to them, it's probably a busy time.
  • Will scan/OCR and submit the assessor's reply to the POPLA thread tomorrow, but my POPLA appeal was successful.

    The case was won on no GPEOL (highlighted was the silly IT costs, but virtually every point JAS made was that of a fixed business cost). Assessor was Christopher Adamson.

    Can't thank ampersand, Coupon-Mad and the rest of the regulars enough: you guys are real stars. Hopefully I can help n00bs as best I can through the process in the future.

    My next step is to make representations to the BPA. There were a couple of points which I'm pretty sure fall foul of the BPA's Code of Conduct. It'll probably do no good, but the JAS/PDC identity shuffle and not sending me the evidence pack is very poor form.

    Well done. Would be great to see you helping the cause for future n00bs. Go for the jugular with the BPA - you've absolutely nothing to lose now.

  • Well, I asked for the BPA to look at the case of the missing evidence pack. I got roughly what I expected.

    JAS say that the pack was sent to both my old address (I was still registered in Bristol when the ticket got issued) and my new one (in Cornwall).

    Amazingly, neither arrived.

    But the very nice BPA chap (amazingly his name is "AOS Investigations Team" - which is a very strange name, but coincidentally brilliant for his job) says that this operator doesn't normally fail to send evidence packs, so he'll keep an eye on it.

    The other point I raised about the JAS/PDC shifting identity - apparently they are going to get the compliance bods to look at that to ensure that the correct address for appeals handling is always on the NtK.

    So, actually, not that bad an experience. I doubt much will come of it, but at least they tried to answer it professionally (before placing it into File 13).

    Is it not time we stopped treating this company as a serious player.

    It has a net worth of minus £9.000, and its website appears to have been constructed by someone whose English is a second language.

    It seems most unlikely to me that, unless it can up its game, it is unlikely ever to be able to able to mount a court case.

    Should it not be put on the "Daft !!!!!!s" list?

    Wholly agree with this. The problem isn't that bunch of jokers; the regulars here treat them with contempt, which is richly deserved.

    It does help to have their silly behaviour on file though, so any future court case, brought by some spiv who buys up PPCs in order to bulk pursue court claims has some defence ready.

    I did actually think that this could be a lucrative sub-market (buying out PPCs for their debt claims and pursue even POPLA winners - you get bounced out of the BPA, but who cares?).

    I would do it myself, but I have a disability preventing such activity. It's called a conscience.
