Hello, I own the freehold to a whole house inc basement. The basement flat however is on a 100 year lease.
I need to do some repair works to the front of the entire house which does include a small portion of the basement. Painting and general maintenence.
There was nothing in the lease about who pays what for repair works except a clause stating that the building insurance should be split 1/3 basement, 2/3 my part (maisonette).
Would the person in the basement be bound to help with the repairs by 1/3 ?
Any advice/help would be really helpful.

What you can charge for is determined by the lease. If there is nothing in the lease that allows you to apportion repair costs, then you can't charge them. Are they paying a service charge?0

When i had a leasehold flat, it stated clearly in the lease that i was responsible for arranging repairs to the upper half of the house and that the other leaseholder had the same with the lower half.0
