Parking Eye - Potential Charge

Hi Everyone

I am probably jumping the gun a little bit here but my paranoid nature has led to me posting on this forum prematurely.

My local shopping park (borehamwood retail park) is ran by parking eye and has a three hour limit on it. It also has a rule whereby you cannot return to the carpark within three hours after leaving it.

Yesterday i went down and parked in the retail park for about an 1 hour 45 minutes (2-3:45). Something came up with meant that i had to back down the road and arrived back at around 17:10 which means a full three hours hadnt elapsed since i LEFT the retail park. I instantly realised i was pulling in as i knew this anyway. Rather than park up I pulled straight out and wasnt in there for any longer than about 45 seconds.

The fact is that I did return when i supposed to and knowing parking eye they will fine me even if it is pathetic that i was only in there for less than a minute.

Who knows.... I might not get fined...But if I do, do you have any advice for me?

    I've never seen a "no return within x hours" ticket issued (actually there was one, but not PE), and there's a very good reason for this: only the driver of the vehicle can enter into ParkingEye's alleged "contract", and when he supposedly enters into the contract it's only binding on him, it can't stop someone else going there in the same car.

    So, to make such a ticket stick ParkingEye would need to prove that the same person was driving on both occasions, which is impossible for them to do.

    I've tried to get tickets of this nature with several companies because in my opinion it would entail a serious breach of the DPA, and I've had not a nibble.

    If you do get a ticket let me know and I'll help you with letters and all sorts. I'm quite local to Borehamstiff.
