PPI Claim

HI MSE forum,
I have just tried to reclaim my PPI from Lloyds who I thought underwrite Mitsubishi finance and so the PPI I thought as well I filled out the required paperwork for the PPI claim for Lloyds only to be told that they didn't sell that policy and that I should contact the dealer that I purchased the car from as the PPI was sold by the dealer and not Lloyds.
Should I go straight to the ombudsman or wait for a response from the dealer as Lloyds have wrote to them explaining what has been done. (I got the letter from Lloyds today)

You need to do as Lloyds have advised and go to the people that sold you the policy in the first place. I would contact them myself, not just wait to see if they contact you once they receive the letter from Lloyds.

You cannot go to the ombudsman until you make the complaint to the seller and they reject you.
Not sure why you wrote to Lloyds as they have nothing to do with it. The dealer has the liability for the sale so you complain to the dealer. Most dealers only become regulated in January 2005. So, if you sale is after that, then fine. If its before then expect to be rejected as pre-regulation.I am an Independent Financial Adviser (IFA). The provider of finance only carries the liability if it was a staff member of theirs that sold it or the seller was an agent of theirs. This is a common mistake. What you have to bear in mind is that you were complaining that you were misSOLD the PPI. With this in mind your complaint needs to go to the seller. Which is the car dealership. It's irrelevant who the actual lender is.
If they gave you FOS rights as part of their response it is theoretically possible that you could go to FOS. However, it would almost certainly be pointless and would waste 12-18 months which could be better spent complaining to the correct party.0
