Hi,
To keep a long story short, we have been on the verge of completion for a few weeks, but had to get a last minute structural engineers report as the (useless) solicitors did not see this requirement in the Mortgage offer until the day before completion.
Report was carried out and everything is okay, but the initial Mortgage Valuer said the report didn't look for 'deleterious materials' as required.
My engineer was adamant that it was in the report and everything was fine and that the Mortgage Valuer is being extremely picky, he wanted to speak to them on the phone, but this is not possible and everything must be done in writing (but not emails!!!)
Bearing in mind it took a fortnight for them to respond about the Engineers Report, this process will probably last even longer!

Here's the problem, the flat we live (rented) has been sold and is due to complete in less than two weeks. Fortunately we get on well with the seller and they have already moved out, he has suggested we set up a shorthold tenancy agreement while the house purchase completes.
This sounds perfect to me, but are there any issues that could arise from this?? I'm thinking we should not tell the solicitors as they might not like it at all. Advice please?

There aren't any problems for you. Your vendor is a fool though.

You are absolutely right, and for very good reasons. Should you decide to go ahead with this foolhardy proposal and your solicitor finds out I imagine you could well find yourself being an ex-client (only funny if said in a John Cleese voice).0 -

But reading the subsequent posts:
your seller would be mad to allow you to move in with an AST:
* he'd be a landlord - with 101 legal obligations
* he'd have to declare it to HMRC for tax
* he'd be in breach of his mortgage agreement (if he has one)
* his insurance would be invalid
* he'd be unable to evict you for 6 months in the event that the whole chain collapses and you end up staying as a tenant, either unable, or refusing, to move out
and on and on and on...
But for you personally? No big problem!0
