High court enforcement - their rights

Just watching a program on TV.

They've entered the girlfriend of the debtors house and said they can seize assets unless she can prove they belong to her. It's her house, they've gathered he lives there on and off.

Surely this can't be right? The actual tenant having to prove goods in HER home?

Comments

  • It's more a case of proving they're not the debtors.

If it's the builder who threatened to get his team round to do them violence the would you trust what the lying !!!! said?

In your house who owns the TV?

    Haven't seen the programme but....

Thats usually the case when the goods are in the property -as there is a reasonable assumption in law that goods in a house belong to the householders.

Not sure if it would be the same if the house was someone elses though. I mean, could anyone prove they own absolutely everything in their own home? I know I couldn't - especially with regards to gifts received from others.

I suppose it really comes down to what their set up is. If the "staying there on and off" is for long periods of time and he's actually been named as a tenant then imo thats different to him never having been on the tenancy and perhaps only staying over one or two nights a week.
