Our seller's wanted to do this as they were going into rented. Our solicitor refused, it is not their money until the contract is completed. Until then it is held by their solicitors and they can't have access other than by agreement and the only time solicitor's will agree is if it is going along the chain.

My solicitor agreed this, but 'lent' the money from his company account. He was very helpful and we used him every time

I am assuming he didnt sign a contract with this LL?

Hopefully the council will be able to find them somewhere, although he should be prepared for temporary accomodation such as a B&B.
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Maybe his GF's family could do something to help since it's their grandchild/niece/nephew (the toddler) who will also be homeless.

I don't know if many exes would be doing as much as you are to even attempt to help, but ultimately it's your ex and his GF's responsibility to provide a roof over the child's head, even if it means kipping on someone's sofa/floor for a few weeks.

I don't know - guessing not but from conversations with the agent and arrangements to pick up keys at he same time as paying a deposit there's been no indication that things aren't all okay. I know that might sound stupid now, but they knew the money wouldn't be there until friday as it's money from the sale and they knew this. They said he could have the keys on fri but if he was able to get the money earlier in the week (i.e day before) the he could have the keys before friday if needed.

    Thank you.

Sadly his GF's parents are both elderly and living in homes.

The annoying thing is that from the sale he will have enough to pay 6 months rent upfront on a small two bed place if it was required. It seems there is a real black hole for people who find themselves in this situation and it must happen to so many people.

We do have a child of our own together so he is more than just an ex I guess.I'm remarried and I just want him to be happy too. If anyone deserves a change of luck it's him. It awful seeing him so ill and distressed.

Doubt it: They would be homeless due to...
    a) Selling a home & leaving it when they did not have to (=there was no court order or bailiff...). Not my rules but Dave's...
    b) He's in trouble as he can't pay the mortgage (ditto).

He is very likely to be found "intentionally homeless" (Dave's rules, not yours or mine) and as such not entitled to either re-housing or housing advice.

Sorry but it's cold & wet on a park bench this time of year...

Renting a holiday home for a couple of weeks might be best, and there will be places available this time of year. Alternatively get the removal company to store the belongings, or find friends with space in their garages, while they stay in a cheap hotel until the sale proceeds come in.
Don't listen to me, I'm no expert!
  • Oh here we go with the never-ending problems. Just cut him loose. It sounds like nobody can do anything and there will never be a right answer as you'll knock back everything anyone says.
