PCN Appeal rejected

Hi

I have been issued a PCN for a ridiculous reason
I was on my way home once and I was stuck in traffic when I saw a man, he needed help so I drove into wickes and left my car and came to assist him, eventualy after 20 mins the police were driving past and pulled the car to a side, I waited with him until the AA arrived, which took atleast over an hour, I went home few days later I recieved a pcn, saying I was in the car park for 105 mins when you are only allowed to stay for 90 mins, I tried contacting the police for a statement so that I can give to g24 with my appeal but they have no record of it as the police were not called in and they were off duty, this was the letter I gave

I am aware of the reason to why I have been issued a PCN, my reason for parking there was unintentional and because of a car breakdown in the middle of a busy road next to a roundabout I was requested to assist the driver so I parked in wickes car park until this matter was resolved. The whole incident will be detailed as follows.

I was driving on London road which is a road between Tesco's and Wickes. I was stuck in traffic and as i was waiting I realised that i had been stationary for the past 6-7 minutes so I decided to take a look and saw that a car was broken down, as I went closer th4e driver of the car which was broken down asked for my assistance so we tried pushing the car, the car did not move. With the best of my knowledge I knew the gearbox was damaged and the car would not move without it being lifted up as it was stuck in gear 3. After some time a green BMW X5 came with is police sirens and pulled the car dragging the tyres over to the side of the road on a bus stop, I continued to assist him until the AA had arrived. Thereafter I moved my car and continued with my journey.

I was forced to park in Wickes car park as the road was blocked and he was in need of assistance, if you feel you are in need of evidence then there are plenty of cameras showing all my actions including my car and the driver which broke down, this can be provided by the council.

After consideration of the information provided by you, your dispute has been unsuccessful as the vehicle was unauthorised for the day in questiom aslo proof of purchase has not been supplied for the day in question therefore the Contractual Parking Charge Notice still applies. As we have extensively investigated this Contractual Parking Charge Notice and provided you with the results of our investigation, no further investigation will be undertaken.

You now have one of the following options available to you:

1. Pay the outstanding Parking Charge. Payment of your Contractual Parking Charge Notice can be made via the payment line: 0845 452 7777 or by sending a cheque or postal order to G24 Limited, PO Box 3320, Gerrards Cross, Buckinghamshire, SL9 8WT.

2. If you believe this decision is incorrect, you are entitled to appeal to the Independent Appeals Service (IAS). In order to appeal the IAS will need your parking charge number, your vehicle registration and the date the charge was originally issued. Appeals must be submitted to the IAS within 21 days of the date of this letter. Please visit for full details.

3. If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with Court action against you.

    you are entitled to appeal to the Independent Appeals Service (IAS).
    ^^Obviously this is your answer.^^
    So start reading 'IAS Decisions' and searching the forum for 'IAS' to read examples. Please, please, please don't send that rubbish appeal to the IAS - that wasn't an appeal, sorry, waste of time. These companies aren't normal - it wasn't a real fine and you can't reason with them with mitigating circumstances.

    So you weren't in the car park - or did you pull in to the Wickes car park and stay there?

    So they are alleging breach of contract so one appeal point will be 'no GPEOL' (read the Newbies thread for the 'acronyms explained' & examples of how to win at IAS). Don't copy the G24 POPLA appeal as this is NOT POPLA.

    Show us a picture of the sign - it's very important to your chances of winning at IAS which you will learn when you search for and read other IAS appeal examples.

    Also slap a quick angry complaint up on Wickes Facebook Page and via Twitter, just in case the IAS appeal doesn't win. DO THAT NOW. Do not submit it to the IAS without showing us your draft first - you have a couple of weeks to get it right and to show us the signage. We will help but you need to read the Newbies sticky thread, you appear to have missed it even though it says 'Private Parking Ticket? Newbies please read these FAQs first!'.
