As jj says, the tenant has been notified
* by the LL that he intends ot seek possession (S21)
* by the court that a possession hearing will take place
* by the court of the result of the hearing, and the date for possession
If the tenant ignores all the above, I see nothing unfair about HC bailiffs just turning up to enforce.
If anything, the question is why should the County Court bailiffs have to give advance warning given that the tenant has blatantly ignored the court order?
I never request(and I assume most don't)that I require a hearing.
The tenant does get plenty of notice that the landlord intends to seek possession.
The Sec 21 gives them "at least" two months notice.
The court will then inform the tenant that the landlord has applied for possession.
The court will then inform the tenant of a date for them to vacate.
No hearing required.Well life is harsh, hug me don't reject me.0 -

But either way, T will have received court documentation and/or hearing, so the eviction hardly comes out of the blue.0 -

Was this programme 'Can't pay? We'll take it away' by any chance? I watched this on Wednesday and was quite upset by the whole thing....it's never easy seeing a grown man cry with his children distraught in the background.
If the story he tells is correct then it sounds like he was a victim of an illegal eviction from his previous home by the LA and then evicted by the same agent from the back up house they sent them to because they hadn't agreed on the level of rent that they should pay (admittedly if he had paid SOMETHING, ANYTHING then this couldn't have happened as quick).
I found the attitude of the LA quite disturbing when interviewed as the eviction was actually taking place 'yes of course I'm really happy, I have my property back!' All whilst 2 children under 3 years old are made to live in a car. He was a nice man.0
