Postcode lottery on day/respite care?

Wonder if someone could help on this one please. The Alzheimers Society factsheet re paying for care clearly states that when paying for care, e.g. respite, daycare, the local authority financial assesment should 'only take into account the finances of the person with dementia, and no one else's' yet our local authority's own factsheet states that they will assess capital of both the dementia sufferer and their partner. I understand (maybe incorrectly) that the Dept of Health issued guidelines on assessing finances for care and that it is up to each local authority to interpret the rules how they see fit. Has anyone any experience of this? It seems as though this might be a case of a postcode lottery situation. Or are my local authority 'trying it on?' Any advice much appreciated. Thank you.
