cancelling purchase of new retirement flat

I paid a reservation fee, deposit and exchanged contacts. Viewed property yesterday and was devistated to find a number of major problems, including the fact that the room sizes are considerably smaller than the plans. The Developers have admitted their mistake and have said that if I decide to cancel they will refund the monies paid to them. However, this has caused me considerable inconvenience and other losses. I shall have to pay my Solicitor for the work they have done, put my present house up for sale and withdrew my investments in June, when the flat was supposed to have been completed.
My question is, do I have a case to claim reimbursement of my losses and compensation for the inconvenience?

Depends what your contract said. Mine quite simply says "The buyer will buy and the seller will sell at the agreed price". Pages of Ts&Cs but that was the contract itself. If there's a plan that formed part of the contract then you may well have a case.0

If the home was offered with a NHBC or LABC warranty then have a look at the Consumer Code For Home Builders Dispute Resolution Scheme. Sorry I can't post link but easy enough to find.
There are examples there of the outcome of cases adjudicated on in the past which you may find encouraging.0 -
